Preface
Welcome to join LetsView membership!
Please carefully read this Agreement before using it. By using the Service, including by clicking to indicate your consent to this Agreement and making any payment in respect of the Service, you signify you have read and understand the Terms, accept them, and agree to be bound by this Agreement. If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access or participate in the Service.
If you are under the age of 18, please read this Agreement in company with your legal guardian
1. Description of Services
1.1 If you need to use the VIP service, you can log in to your account on the mobile phone or computer. After logging in, you can get the membership by purchasing or receiving the VIP as a gift from others. Your license is valid within the validity period.
1.2 As a VIP member, You will be entitled to enjoy the benefits of Membership, including removing the watermark, full-screen display etc. You acknowledge and agree that, notwithstanding the terms herein, the actual Membership benefits posted in the “Recharge Center” shall prevail.
2. Membership and Subscription
2.1 You certify that You have registered for the Membership based on true, accurate, legal and valid personal information. You further certify that all additional personal information You may provide from time to time will be true, accurate, legal, and valid personal information. If there is any change to your personal information, You shall promptly update your LetsView account with such new personal information in a timely manner.
2.2 You are solely responsible for maintaining your LetsView account, account information, and account password properly. You shall take all necessary and effective measures to secure your account information and password. To the extent permitted by applicable laws, LetsView will not be liable for the leakage of your account information (including your password) not caused by LetsView and/or any losses caused by your improper use or maintenance of your account.
2.3 You understand and agree that after upgrading to VIP, there is no login restriction for mobile devices (mobile phones, tablets) while there are some restrictions for PC and Mac. For personal licenses (including monthly, quarterly, annual, and lifetime versions), you can install and use one copy of the Software on a single computer at a time; Family lifetime licenses allow you to log in to the account on 5 devices.
2.4 This app and its materials (including, but not limited to texts, graphics, logos, sounds and software) are the copyrighted material of LetsView Limited. All rights reserved. No part of this publication may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical methods, without the prior written permission of LetsView Limited excluding the following situations:
1. You may print or download extracts to a local hard disk for your personal and non-commercial use only.
2. You may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.
3. Service Use Rules
3.1 Differencesof devices and systems
You acknowledge that the specific Membership benefits, Content, or Service available may vary from time to time, including as a result of different software versions, device capabilities, operating systems, and other third-party reasons. LetsView recommends that You resolve any such problems by upgrading the application or operating system, using a different device, or contacting us at support@letsview.com.
3.2License Fee
This VIP service is provided by LetsView. You shall pay the charges to us in accordance with this Agreement in order to use the VIP service. In addition, you can use it if you receive the VIP as a gift or through other ways permitted by LetsView.
LetsView shall modify and change relevant rights and interests, charging standards and methods according to the overall plan of this service. The aforesaid modifications and changes shall be demonstrated on corresponding pages. Besides, LetsView will offer different discounts for users who want to buy or renew the VIP license, and the discount shall be announced on relevant pages.
3.3 Payment
3.3.1 In the iOS system, you can purchase in App Store and it is non-refundable; while for Android, PC and Mac, you can pay via PayPal, Credit Card, and other payment methods accepted by LetsView according to the Agreement. After payment, you can request a refund in 30 days without giving reasons. When placing an order, please check and confirm your account and choose relevant options carefully. If there shall be damage to your rights and interests because you subscribed for the wrong account or selected an unwanted charging type by inputting a wrong account, an improper operation, or not understanding the charging method and the like, LetsView will not make any compensation.
3.3.2 You shall not subscribe for yourself or others by:
1) subscribing for yourself or others for profit or business purposes without authorization of LetsView;
2)subscribing for yourself or others by any robot software, spider software,crawler software and the like.
3)subscribing for yourself or others by any improper means or in breach of goodfaith;
4) subscribing for yourself or others in a way not approved by LetsView;
5) subscribing for yourself or others in ways of infringement of the legal rights of LetsView or others;
6)subscribing for yourself or others through other ways that violate relevantlaws, administrative regulations, and national policies, etc.
3.4Duration of Service
3.4.1The duration of this service is subject to the corresponding subscriptionperiod that you choose and pay for. You can also go to the corresponding pagesof this Agreement to check it.
3.4.2 You acknowledge and agree that LetsView will not make any compensation for: the duration of this service, including a reasonable time for bug fixing, server maintenance, adjustment, upgrade, and handling of third-party infringement, etc.
3.5Guidelines for use
3.5.1 This service shall not be used for any infringement of the intellectual property rights, property rights, and reputation rights of LetsView and any third party;
3.5.2 This is a payable service; by any means of infringement upon the charging, LetsView shall have the right to hold the perpetrator accountable and to claim compensation;
3.5.3This service shall not be used to harm or suspected to harm minors;
3.6.4 This service shall not be used for any engagement in any violation of laws, regulations, policies, social morality, and the like;
3.6.5You acknowledge and agree, you shall be responsible for all actions in youraccount, including but not limited to mirroring your device to a public screenand any consequences arising therefrom.
4. Collection, Use and Protection of Personal Information of Membership
4.1 You acknowledge and agree: to fulfill this Agreement, we collect your personal information that you provided when using our services, including your account, nickname, avatar, phone number, etc., or information that we need for the sake of your account security, user experience optimization and the like. LetsView’s collection of your personal information will follow the provisions of this Agreement, relevant privacy policies and laws.
4.2 You acknowledge and agree: in order to provide better screen mirroring services, LetsView shall collect your personal information and inform you of our activities, personalized recommendation information and promotion information on the LetsView website, in applications, or through text messages, calls, and emails.
4.3 We follow the principle to protect your personal information and privacy. Except as otherwise to this Agreement, the collection, use and protection of your personal information by LetsView for membership services will be governed by the privacy policy published by LetsView.
5. Liability for Breach of Contract
5.1 Whenusing this service, you shall not breach the contract by:
5.1.1 Any breach of this Agreement;
5.1.2 Any violation of laws, regulations, rules, and normative provisions;
5.1.3 Destroying or affecting the provision of this service to any third party;
5.1.4 Any behavior that damages network security;
5.1.5 Causing adverse effects on the services and activities of this Agreement provided by LetsView and associated third parties (including authorized parties and partners), and infringing upon and/or the legitimate interests of associated third parties and/or other users;
5.1.6 Any infringement of the legal rights and interests of any third party found by the relevant department;
5.1.7 Making illegal benefits using this service, including but not limited to gaining improper profits through resale, transfer, delegation of authority, etc.
5.1.8 Other infringement of legal rights and interest of LetsView.
5.2Treatment for Breach of Contract
You confirm and agree, once there shall be a breach of contract, LetsView shall have the right to take one or more of the following actions:
5.2.1delete or block the relevant information;
5.2.2suspend or terminate part or all of this service;
5.2.3 the unused service fee shall be owned by LetsView as liquidated damages, and we shall not refund any fees. The loss in your account (including but not limited to the loss of video data and the reduction of virtual products etc.) shall be at your own expense, and you shall also be compensated for the loss of LetsView (including but not limited to attorney’s fees, litigation fees, etc.)
5.3Compensation Liability
If your breach of contract shall cause any damage to LetsView and its affiliates, including direct economic loss and indirect economic losses, such as loss of business reputation, compensation, settlement, lawyer’s fee, litigation fee, etc., you shall be compensated for all the aforesaid loss to LetsView and its affiliates.
If yourbreach of contract shall cause damage to any third party, you shall beindependently liable to the third party.
6. Disclaimer
6.1 You shall make independent judgment in the use, viewing, sharing, referring, or forwarding of relevant information and contents (collectively referred to as “user behavior”). For any damage to yourself or third parties caused by your user behavior, LetsView does not bear any responsibility.
6.2 LetsView will not make any compensation if your account or account property is reduced or lost due to the following reasons: computer failure, system instability, force majeure (such as server reasons) and other issues that are not caused by LetsView.
7. Intellectual Property
7.1 LetsView is the owner of all intellectual property rights in LetsView. All the copyrights, trademarks, patents, trade secrets or other legitimate rights and interests in LetsView (including all related materials, supported components or constituent elements and LetsView as a whole), as well as all information (including texts, pictures, audio, videos, charts, interface design, framework, relevant data or electronic documents, etc.) related to LetsView are protected by the laws and regulations of the United States. LetsView enjoys the above-mentioned intellectual property rights and legitimate rights and interests, except for the rights that the relevant obligee should enjoy in accordance with the provisions of the law. You shall not in any way make commercial use of the LetsView (including all related materials, supported components or constituent elements and LetsView as a whole) without prior written consent.
7.2 LetsView may involve the intellectual property rights of third parties. If the third party has a requirement for you to use it in LetsView in accordance with this Agreement, LetsView will notify you in an appropriate manner and you shall comply with it.
8. Suspension, Termination and Modification
8.1Either party shall have the right on notice the other party to suspend orterminate this Agreement if:
8.1.1the user shall suspend or terminate the service, including but not limited tonon-renewal when expired;
8.1.1 If the user is in breach of this Agreement, LetsView shall suspend or terminate the service;
8.1.2 it is at the request of the country or relevant department or in the event of force majeure, LetsView shall suspend or terminate the service;
8.1.3there shall be suspension or termination according to other laws and regulations.
8.2 After the suspension or termination of the service, LetsView has the right but not the obligation to ensure that you receive special notice. If you find that you can no longer log in or enjoy the service, consult customer service.
8.3After Suspension or Termination
8.3.1 LetsView shall not be liable to the user or any third party for the suspension or termination of this service except for the liability under the law.
8.3.2 For the iOS system, fees deducted by App Store are nonrefundable; for other platforms, a user shall request a refund within 30 days without giving reasons.
8.4 You agree, that due to the particularity of Internet services, LetsView has the right to modify, change, pause or terminate some or all of the services, or to change, delete, and transfer the contents stored or published in LetsView by the user (collectively referred to as “change behavior”). We reserve the right to take the aforesaid change behavior without informing you, and you agree that service provided under any provisions of this Agreement shall be modified, paused or terminated without prior notice. In addition, you agree that no liability to you or any third party is required for any loss caused by the change.
9. Notice
Allnotices under this Agreement will be sent to users by webpage announcement,direct messages, in-app message push, email, text messages, and the like. Anynotices given as aforesaid shall be deemed to have been given on the date ofsuch delivery.
You shall make sure that all the contact information are correct and valid so that you can receive notices. If there shall be a change in your contact information, you need to log in to LetsView and modify it. If you provide incorrect contact information or update your contact information without informing LetsView on time, resulting in a failure to receive notices timely, then you shall bear losses and legal consequences.
LetsView shall deliver all kinds of notices to you by one or several of the above means, and the contents of such notices may have a significant (good or bad) influence on you. Therefore, please make sure that the contact information is valid, and pay close attention to the corresponding notice.
9.1 Effectiveness
When youuse this service, you shall be deemed to have read and agreed to be bound bythis Agreement.
9.2 Dispute Resolution
If there shall be any dispute between you and LetsView, you should settle it through friendly consultation at first; if the negotiation fails, you agree to submit the dispute to the people’s court where LetsView resides.
9.3 Headings
The headings used in this Agreement are for reference purposes only and do not constitute substantive matters to be considered in construing the terms of this Agreement.
9.4 Validity and Enforceability
The terms of this agreement shall be partially invalid or unenforceable for any reason, and the remaining terms shall be valid and binding on both parties.
Attachment: Auto-renewal Subscription
LetsView accepts certain debit and credit cards as well as other forms of cash payment (e.g., PayPal transfers) as payment methods for Paid Services (each, an “Accepted Payment Method”), subject to the procedures and rules contained in these Commercial Terms and any applicable contract with the Accepted Payment Method. Accepted Payment Methods may vary by country or by Paid Service and may change from time to time. When you purchase with an Accepted Payment Method, the fees for your Paid Service will be billed on or near the date of your purchase. If you purchase a Paid Service subscription that renews automatically, such as monthly or annually, you agree that we may process your Accepted Payment Method on each monthly, annual, or other renewal terms (based on the applicable billing cycle), on or near the calendar day corresponding to the commencement of your Paid Service subscription, as applicable. See “Cancellation” below for information on how to cancel a Paid Service subscription. In addition, you agree that we have permission to retain and/or share with financial institutions and payment processing firms (including any institutions or firms we retain in the future) information regarding your purchase and your submitted payment information in order to process your purchase, and to use the email address submitted by you to provide you with notices and disclosures relating to renewals and recurring charges. If your Paid Service subscription began on a day not contained in a subsequent month (e.g., your service began on January 30, and there is no February 30), LetsView will process your payment on or near the last day of such month. (This is what we mean by paying on an autorenewal basis.) See below for information describing what you must do to change your Accepted Payment Method.
Cancellation of a Paid Service Subscription
You may elect to cancel a Paid Service at any time. Any cancellation of a Paid Service will be effective as of the end of the then-current billing period and subject to our Refund Policy, except as described below for an upgrade in Paid Service.
Auto-Renewal
Subscription plan: We provide 2 subscription plans, Annual Subscription and Monthly Subscription
Payment: After confirming the purchase, your purchase account will be charged.
Renewal: You will be automatically charged 24 hours prior to the expiration of each billing cycle.
Cancel renewal: You can cancel your subscription at least 24 hours prior to the expiration of the existing plan. If you desire to cancel your subscription for the LetsView Paid Service, you can refer to the following guide.
How to cancel a subscription from Apple
- Open the Settings app.
- Tap your name.
- Tap Subscriptions.
- Tap the subscription that you want to manage.
- Tap Cancel Subscription.
- If you don’t see Cancel, the subscription is already canceled and won’t renew.
How to cancel a subscription from Google Play
- Go to play.google.com.
- Sign in to the correct Google Account.
- At the left, click My subscriptions.
- Select the subscription you want to cancel.
- Click Manage and Cancel subscription.
Contact the support
- Contact LetsView Support Center.
- Provide the order number and describe the reason to cancel a subscription.
- Or you can click the live chat icon at the bottom right corner of the official website.
If you wish to upgrade your existing Paid Service subscription to a more expensive level of Paid Service, and if you purchased your current Paid Service directly from LetsView (and not from a reseller or payment processor), please contact customer support support@letsview.com. If you have purchased a Paid Service from a reseller or payment processor, you may be required to contact the reseller or payment processor to process your cancellation request, as LetsView may have no ability to process the cancellation for you.
If you are the authorized legal representative for a deceased or legally incapacitated individual or a legal entity that has been formally dissolved or otherwise ceased to be authorized to act for his, her, or its own account (without opportunity for revival), and you wish to cancel a current Paid Service subscription for such individual or entity, you must contact the Customer Support, identify the account in question and request cancellation of the Paid Service. We will cancel the Paid Service subscription if you demonstrate to our satisfaction your legal authority to act and be legally responsible for such an individual or entity and your ability to validate the details of the payment method used for such Paid Service.
We may cancel any Paid Service subscription you have purchased if you fail to pay the applicable subscription fees and any applicable taxes in full and in a timely manner according to these Commercial Terms or any agreement with a third-party reseller or payment processor. A failure to pay occurs in any situation where LetsView has not received timely payment, including where any credit card issuer or payer bank refuses to transmit the funds that are then due, or the reseller or payment processor you have contracted with notifies us of your failure to pay. We may, at our discretion, elect not to cancel a Paid Service subscription immediately for non-payment, in which case you will continue to be responsible for the fees due for the duration of the applicable subscription. In addition, if you fail to pay for a Paid Service, we may elect to suspend your rights to use that Paid Service or we may change the type of privileges you have to a non-paid version of the service. We will endeavor to provide you notice promptly after any failure to make a payment to us in full and on time, but we are not obligated to do so.
In the event of a conflict, the English language version shall govern.
